1. Legal rules for determining whether a person has sufficient mental capacity to make a decision e.g financial decision 2. principles upon which decisions are to be made when a person is assessed as lacking capacity 3. ability for people to make advance directions to refuse medical treatment in case they lose capacity in the future |

1. A Presumption of capacity (s1(2)) 2. all practicable to be taken to help a person make own decision (s1(3)) 3. unwise decision in itself does not mean a person cannot make a decision (s1(4)) 4. Acts/decisions on behalf of a person must be his/her best interests (s1(5)) 5.least restrictive option must guide acts/decisions |
