Criminal
behaviors that are offensive to society. These behaviors do not benefit society as a whole (murder, rape, robbery or assault)
Civil
behaviors/actions that violate the right of others in society. A complaint of a civil wrong is filed against the person who committed the crime
Appeal
request a review of the decision
Assault
intentional threat to cause a bodily harm to another
Battery
unlawful touching of another person without informed consent
Complaint
written statement by the plaintiff
Damages
compensation that the plaintiff is seeking
Defendant
the person that is legally responsible
Deposition
a question and answer session under oath during which attorneys ask the witness questions relating to issues of the lawsuit
False Imprisonment
holding someone against their will
Libel
a malicious or untrue writing about another person that is brought to the attention of others
Malpractice
Failure to meet a legal duty, thus causing harm to another
Negligence
The doing of an act or the not doing of an act that reasonably prudent person would have performed in a similar situation, thus causing harm to another person
Plaintiff
the complaining party
Slander
Malicious or untrue spoken words about another person that are brought to the attention of others
Summons
a court order that notifies the defendant of the legal system
Tort
a type of civil law that involves wrongs against a person or property
Verdict
a decision, based on the basis of the case
Accountability
legal responsibility for one's own actions or failure to act
Advocate
to protect or safeguard what is the best interest of your patient or residents
4 parts of Malpractice
1. duty: must be established between nurse and patient
2. breech in duty: failure to perform the duty in a reasonable prudent matter
3. harm: has occurred
4. proximate harm: must be linked back to the duty
Patients Rights
*right to have access to health care without any prejudice
*right to be treated with respect and dignity
*right to privacy and confidentiality
*right to personal safety
*right to complete information about one's own treatment and condition
Informed Consent
the patients right to make decisions regarding his/her health care
Confidentiality
guard the information you receive about a patient, and restrict access to it to only those health care professionals who have a need to know it
HIPPA
prevents unauthorized disclosure of medical records and patient information
Medical Records
laws govern the collection, maintenance and disclosure of information in medical records
Invasion of Privacy
involves a person's right to be left alone and remain anonymous if he or she chooses. Don't expose the patient in any form
Reporting suspected abuse/domestic violence
health care professionals are required to report certain information to the appropriate authorities
Priority
must be able to determine what to do first
Self-Motivation
have to have initiative and drive to do things
Competence
Know what you are capable of doing and have faith in oneself to complete it
Discretion
know when to decide if something is right or wrong
Honesty
must be truthful with everyone including oneself
Integrity
Know what one's morals and ethics are

must always be prompt and on time and make it so people can count on you
Euthanasia
Deliberately bringing about the death of a person who is suffering from an incurable disease or condition: can be done actively or passively
Ethics
relationship between moral actions and values and how these attributes affect influence society
Values
personal beliefs about worth of an object, a custom, or attitude
Culture
Cultural background can influence the actions and values of a particular group in society
