Laws on using intoxication as a defence are good because...

It protects victims who have been involuntarily intoxicated eg drinks spiked.

One issue with using intoxication as a defence is that...

Alcohol is readily available to adults that it is easy to rely on it. Therefore it is often used as a defence. Needs to be limited as victims need more protection

For murder D can use intoxication as a defence causing issues with justice..

However because intoxication is not offered as a defence to a basic intent offence, D can be found guilty of a lower level offence eg manslaughter

Proposals for law reform

Involuntary intoxication; law commission proposed there should be a list of situations that count as ‘involuntary’ + this should be considered when deciding if D had required MR

(At time of writing no action has been taken on any of these proposals)
