Small Business

$10k to SAT automatically set-aside for SB unless CO determines there is no reasonable expectation of obtaining competitive offers from 2 or more small businesses

>SAT - shall be set-aside for SB when the CO determines there is a reasonable expectation that offers will be obtained from at least 2 responsible SB concerns & award will be made at fair market price

8(a) program

Supply actions above $7M and service actions above $4M are awarded on a competitive basis. (Under those amounts are non-competitively awarded)

Subcontracting Plans

Required for actions over $700K / $1.5 for construction

Exceptions

-Prime is a SB

-No significant subcontracting opportunities exist

—CO determination required and approved one level above CO

—coordinated in writing with SB

Subcontracting Plan Elements

Separate % goals for SB and each category of SB

Total $$ planned for subcontracting and $$ planned for each category of SB

Principal types of supplies/services to be subcontracted

Method used to develop subcontracting goals

Efforts offeror will make to ensure each SB category will have equitable opportunity to compete for subcontracts

If SDB goal is 5% or less, must be approved one level above the CO

Certificate of Competency

Issued by SBA stating holder is responsible to receive and perform on a specific contract

Required when an apparent successful SB offeror is determined non-responsible by the PCO

-withhold award

-Refer to SBA area office

—SBA has 15 days to inform SB & offer a chance to apply for CoC; deny issuance of a CoC and notify PCO; indicate decision to issue a CoC & notify the PCO

PCO may appeal issuance of the CoC if action is greater than $100k

-final decision made by SBA HQ

Protesting SB Status

Notify other offerors in a SB set-aside of intent you award

-must file w/in 5 days

-SBA makes decision (10 days to decide)
