Definitions

What does article 10 define?

Offense

Conduct for which a sentence of imprisonment or to a fine is provided by any law of this state, or by any law local or otherwise

Offenses defined in the vehicle and traffic law

Offenses, VTL

Violation

An offense *other than a traffic infraction* for which a sentence to a term of imprisonment in excess of 15 days *cannot* be imposed

Other than a traffic infraction, sentence in excess of 15 day may be imposed, but imprisonment in excess of one year cannot be imposed

May be more than 15, cannot be more than one year

Felony

An offense for which a sentence of imprisonment in excess of one year may be imposed

Over a year, May be imposed

Crime

A misdemeanor or felony

Physical injury

Impairment of physical condition or substantial pain

Impairment or pain

Serious physical injury

Physical injury which can lead to death, impairment or disfigurement

Can lead to death, impairment, or disfigurement

Deadly physical force

Force readily capable of causing death or other physical injury

Deadly weapon

Any loaded weapon from which a shot capable of causing death or physical injury may be discharged. Or a switchblade, gravity knife, etc...

A person 13 years old, who is criminally responsible for acts of murder 2nd degree or as part of a sexually motivated felony.

14 or 15 years old criminally responsible for acts of, murder 2nd degree, kidnapping 1st, arson 1st or 2nd, assault 1st, manslaughter 1st, rape 1st, Criminal sexual act 1st, aggravated sexual accuse 1st, burglary 1st or 2nd, robbery 1st or second, possession of a machine gun or forearm on school grounds

13 - murder/ sexually motivated felony


14 and 15 - other felonies
