Clean break principle |
Allows parties to be financially independent without position changing. Under s25A MCA 1973 courts have a duty to consider whether a clean break is appropriate. Not usually where children are involved. Delayed clean breaks may be made e.g. if one party needs to retrain and requires support in the meantime |
