When is a claim allocated to the fast-track? |
A claim is allocated to the fast-track where the value of the claim is above 10k but under 25k. A personal injury claim where damages more than 1k is sought for pain, suffering and loss of amenity. Where a trial can be dealt with in a single day. |

Standard directions in a fast track claim are: Disclousure of documents - 4 weeks. Inspection of documents - 7 days after disclosure Exchange of witness statements - 10 weeks Exchange of experts reports - 14 weeks Service of pre-trial checklists by the court - 20 weeks Return of pre-trial checklists - 22 weeks Trial - 30 weeks |

How are experts dealt with in fast track cases ? |
Usually, where an expert is required, the court will order the parties jointly instruct a single expert. An experts duty is to the court, regardless of the instructing party. An expert is not usally required to attend trial. |

How are costs dealt with in a fast track case? |
Usually, in a non-personal injury case, costs will be summarily assessed at the end of the trial. Each party is required to file a schedule of costs and serve the same on the other party atleast 48 hours prior to the trial. Guideline fee rates are published for solicitors from grade 1-4 or a to d Costs must also be proprotionate. |
