When can exemptions be claimed?
The following exemptions can be claimed if the observance of that provision would be likely to hinder the use of the vehicle for the purpose for which it is being used on that occasion.
What are the exemptions for any category of patient
Stopping on Clearways.
Leaving the engine running while parked.
Parking within zigzags of a pedestrian crossing.
Parking within the areas controlled by double white, yellow or red lines.
Parking on the offside of the road at night.
Parking on the footway, verge or central reservation.
What exemptions can be claimed in emergencies only?
Exceeding statutory limits.
Treating a red light as a give way.
Use of audible warnings at night.
Observing keep left/right signs.
Motorway regulations.
Entering a bus lane during its hours of operation.
Entering a pedestrian precinct.
What is driving without due care and attention?
Driving that falls below the standard expected of a competent and careful driver by driving in a manner that does not show reasonable consideration for other persons using the road or pathways.
What is driving without reasonable consideration?
If you drive a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration. Driving in a manner that may inconvenience other drivers.
What is dangerous driving?
When a persons standard of driving falls far below what would be expected of a competent and careful driver and it would be obvious to a competent and careful driver that driving in that way would be dangerous. If the driver has of his or her own free will adopted a particular way of driving, and also where there is a substantial error of judgement.
What is red mist?
Driving in emergency response is demanding and can be stressful.
Red mist means your attention is not on your driving but on some other specific goal; you have become emotionally and physiologically caught up in the incident.
It is a term used to describe the state of mind of a driver who becomes determined to achieve some objective on the journey, catching a vehicle in front or getting to an incident in the shortest time.
Fixed attention on a particular goal can lead to blindness to other potential hazards such as pedestrians or other vehicles at intersections.
This means the driver is at best less able and at worst no longer capable of realistically assessing driving risk.
The key to preventing this state of mind is to concentrate on the driving task rather than the incident.
