-means if all 4 elements are satisfied d is convicted
-fair as d has committed 2 crimes theft + non fatal
ADVANTAGE - wide ranging
-ppl can be convicted if use force or threaten force
-closes loopholes and takes affect on victim into account
ADVANTAGE - timing is interpreted in diff ways
-means force normally has to occur before or at time but court allow continuing
-fair as stops d getting away with force after theft
ADVANTAGE - it is certain
-means law is covered under s8 so is certain for judges to follow
-good because lawyers and. citizens can predict outcome
DISADVANTAGE - too wide
-means d can be guilty even if they don’t touch v so could be unfair
-robbery is an indictable offence so can carry serious punishment even when v has only been nudged
DISADVANTAGE - sentencing is unfair
-robbery carries up to life and can be anything from push to armed robbery
-research shows there is less serious robbery now and more just phone robbery
DISADVANTAGE - inconsistent
-for theft it is instant the minute u touch item but for robbery theft can be continuing so is confusing
-difficult to predict outcome and jury usually decide
DISADVANTAGE - lack of definition
-most parts of robbery not defined so judges have to define them
-undemocratic as judges are not elected so goes against sovereignty
