An individuals responsibility to provide patient care. Responsibility comes from either statute or function
What is negligence?
It is the failure to provide the same care that a person with similar training would provide. It is deviation from the accepted standard of care that may result in further injury to the patient

What is abandonment?
The unilateral termination of care by the emt-b without the patients consent and without making any provisions for continuing care by a medical professional
What is the difference between expressed and informed consent?
Expressed is the type of consent in which the patient speaks or acknowledges that he or she wants you to provide care
Informed is the patient has been told of potential risks or benefits and alternatives to treatment and has given consent
What is implied consent?
When a person is unconscious and unable to give consent or when a serious threat to life or limb exists, the law assumes that the patient would consent to care
Mentally incompetent adults
From a legal perspective, this situation is similar to those involving minors. Consent for emergency care should be obtained from someone who is legally responsible
What is assault and battery?
Assault is defined as unlawfully placing a person in fears of immediate bodily harm
Battery is unlawfully touching a person; this includes providing emergency care without consent
What is forcible restraint?
The act of physically preventing an individual from any physical action
