S1(1) Criminal Attempts Act 1981

Intent to commit (any indictable or either way offence) when a person does an act that is more than merely preparatory to the commission of the offence

Boyle and Boyle (1987)

Attempted burglary - d's intended to commit burglary and went as far as damaging a door trying to enter the house

Jones (1990)

Attempted murder - got sawn off shotgun and a hatchet and length of cord, got into v's car and made him drive to a secluded place. He pointed the shotgun at v but v managed to escape. More than merely preparatory as he pointed gun at v with intention of killing him

Gullefer (1990)

D not guilty of attempted theft. He ran onto a greyhound track to disrupt the race and declare the race void so he could get his money back (his chosen bet was running badly) the disruption was minor and the result of the race was allowed to stand so his act was not more than merely preparatory

Campbell (1991)

D was arrested with an imitation firearm, he was one yard from the post office he intended to rob when arrested. He argued he had changed his mind about the robbery and it was held there was insufficient evidence to show his acts were more than merely preparatory

Mens rea/ actus Reus of attempt

The mens rea is the same as for the actual full offence (whether the d intended to commit the crime proper) the actus Reus is the acts d did that were more than merely preparatory in the commission of the crime - d does not have to do last act to complete the crime proper but has to come close
