Quasi-judicial is a contested case. Quasi-executive is a non-contested case. Quasi-legislative is a rulemaking case. A contested case is an adjudicatory proceeding in which individual legal rights, duties, privileges of a party are required by law to be determined by an agency only after a hearing. If contested case, must 1) right to present evidence 2) knowledge of opposing evidence 3) the opportunity to test and rebut opposing evidence 4) the decision must be based solely on evidence produced at the hearing. A rule is defined as an "agency statement of general applicability that implements, applies, interprets or prescribes law and policy" or an amendment/repeal thereof. |
