I am an insurance adjuster. I case review auto and injury claims for the West Coast. My negotiation opportunity is a two car accident our insured party A versus a claimant party B.
During the recorded statement party A states they were traveling down a one way road approaching a four way uncontrolled intersection to make a right turn. As vehicle A made the right turn they collided with the front driver side of vehicle B that had pulled up to the right side of them also to make a right turn.
Party B states they were traveling down a one way with a road large enough for two vehicles. As they came upon the uncontrolled intersection they witnessed party A to the left side of the road, they were not using blinkers and it was unclear what their intention was, however it appeared as they were going to make a left. Since there was enough room for another vehicle party B proceeded, preparing to make a right hand turn. As party B stopped to clear the intersection, party A then turned right colliding with the front driver side of party B.
Party B states, party A was in a position to make a left turn and assumed the driver was going to do such and felt it was safe to approach the intersection and make a right turn. I will clarify the intention of party A and ask if they were using signals. I will ask party B if they witnessed party A using signals. I will ask how fast either driver was going, if they could see each other before the impact and if either party did anything to try and avoid the accident such as honk or swerve etc.
I will ensure I listen to both parties by listening to take facts of the conversation and prepare follow up questions. I want to ensure I do not over talk them or cut their thought process short since it could remove an important detail or fact of the situation.
