In the place where I worked, both the patient and the clinician sign the HIPAA privacy form for every admission. It is in addition to orientation on the law and regulation. No evidence was presented to deny Dr. Zhou claim that he did know about the law. Let assume that you were the persecutor, would you make this as part of your supportive argument. What do you think was Zhou motives. The facility could have also been fined base of the law for up to $10,000 for negligent because of their failure to protect patients records for each he accessed the electronic patient system after he was terminated. The first story is about An Alabama woman that has been charged with violation of the HIPAA privacy rule for stealing paper surgery schedules about 4,500 patients from Trinity Medical Center in Birmingham. She was then using the names of these patients as well as their date of birth and social security numbers to commit identity theft.
