Hi Willem, I agree with your response that the court’s decision in favor of Wrench LLC was correct. Taco bell made it clear that they were interested in using the concepts created by Wrench LLC. They approached the company, because they liked the idea of the Psycho Chihuahua, and wanted to use it in their ads. As you said they even accepted hats, stickers, and t-shirts with the Taco Bell Logo and the Psycho Chihuahua on them.
Their actions made it seem as if they were going to pay for the services rendered. What’s scary to me is how they simply used this smaller company for their benefit. They knew well that the ideas they gave to the other ad agency was not theirs to give away. They seemed to play on the ignorance of the smaller company.
