His case has been established for injuries to the back, head, both shoulders and both knees with an average weekly wage of $488.74. A finding has been made that your husband has a permanent total disability and he should be receiving benefits at the permanent total disability rate of $300.00 per week.

Regardless of the settlement offer reached by the codefendants with the plaintiff’s attorney, it was the position of HAPI (CRC Panel), their defense counsel and the insured to defend this claim. Moreover, and taking into account favorable testimony from defendants (Sandusky & Pearce) on behalf of their insured, it was defense counsel’s position the insured had a 75% chance of a successful outcome at trial. However, even with defendants (Sandusky & Pearce) testifying on the insured’s behalf, the jury awarded the claimant’s spouse $2.7 million, noting all defendants failed in the standard of care provided to the claimant. I think when people tell you thank you for your help, they were the most rewarding experience. For example, I had a woman who did not know how to claim for a work accident because her manager told her that because she was undocumented, she did not have right to claim for anything. I told her that her employer was wrong and she can claim for Workers Compensation that it is an insurance that companies has to pay for their employees even they are undocumented. I read a pamphlet that the Labor Commission left to my organization. She told me, thank you so much for your help.…
