This contract is informal because no special form is needed; express, because the terms were listed in the contract; and bilateral, because Stark State is promising to pay ABC for the construction of a building. Wonderful Brick Company is an incidental beneficiary because they are benefiting from the contract between Stark State and ABC. Mason Contractors is a delegatee because ABC contractors are delegating to them the duty of laying the brick for the building. When ABC notified Stark State that they could not finish the building on time they are giving notice by anticipatory repudiation. Stark State then had the right to find someone else to finish the work on time. They can then sue ABC for compensatory damages to cover the added cost
