Balancing rights is important because the service users will feel safe and are not being abused or neglected as their human and civil rights are being met by the healthcare professionals.
Steven Hoskin case study
In the Steven Hoskin case study his rights were not met as he was being abused. Steven Hoskin had repeatedly called up services such as the police and care services, for several matters including threats. The staff members who were supposed to be caring for and supporting the vulnerable adults with learning disabilities and autism, where abusing and neglecting the service users. This is not balancing individual rights because the staff were taking away the right to feel safe, not to be abused or frightened. Two service users named Simon and Simone were abused physically as one of the staff members would play “a boxing game” with Simon where they would proceed to punch him until he said “ding, ding” to end it, however the staff member wouldn’t always stop. Simone was also abused physically as some of the staff members poured freezing water over her in minus degree weather. The staff would also use cold showers as a form of punishment, this takes away their rights as they are being abused. A staff member named Wayne frequently put service users underneath a chair and then sat on it, Simone was often a victim of this abuse, she was also slapped across the face and another staff member kneeled across Simone while she was underneath the chair. This took away the service users rights as the service users did not get the right to be listened to as when they pleaded for the staff to stop doing abusive things to them. The service users are also not getting the right to care and support as the hospital is not giving the therapeutic environment that the service users need as the staff are abusing them, there is no activities for the service users to do to help stimulate them and help them to learn and the staff also restrain the service users for the first option instead of looking for alternative options to help calm the service users.
