Rifkin didn’t want that either “no, we definitely don’t want to get the Legal Department in the middle of this.” If the “alleged incident” didn’t happen at RHD or during work hours, “there is nothing we can or should do legally.” Wilson wrote back on June 24 at 9:11 am, even more confused. Rifkin replied at 9:26 am, telling Wilson that he was not to investigate the incident. “I didn’t want to imply that you need to, and don’t tell the accused employee about this. When I say we need to know the full story, I just mean that we need to know why the alleged victim decided to tell Rebecca about this 8 months after the alleged incident, if she claims that anything has happened between the employees since the alleged incident, and what exactly she wants us to do. This doesn’t require you investigating anything, you just need to ask Rebecca what exactly she was told.” Once again, Rifkin’s claim in the Position statement that “Human Resources decided to investigate” whether Hoder had engaged in any other improper conduct” is directly contradicted by Rifkin’s own statement that Wilson was not to investigate anything; he was only supposed to find out why it took Complainant so long to report the incident based on what Dimant had already been told.

On June 23, Wilson emailed RHD Corporate counsel Jeremy Rifkin, who authored RHD’s Position Statement. Wilson told Rifkin that had “an issues” and asked for guidance about how to handle it, having first contacted Dale Anderson, from Corporate Human Resources. Wilson reported Complainant had been “date raped” by Hoder, and that Hoder and Complainant “need to work closely” together.
