For this situation, I would assume that I would already have the signed Location Agreement on hand, like Erika said. This would be helpful in case the storekeeper wants to back out of the agreement. Therefore, I would be able to show the document to them in order to explain that they had signed a contract. However, in order to keep the storekeeper happy, I would speak with the director to see if not blocking access to the store is possible. If it is possible, I would work with the crew and storekeeper to allow access to the shop.…

According to the textbook in chapter 13 a court will examine the adequacy of consideration when “fraud, undue influence, duress, or the lack of a bargained-for exchange may be involved”. So basically it is there to make sure the bargain is fair. In this case the circumstances appear because we know that Martha Carr was diagnosed with schizophrenia and depression and had to go to the hospital numerous times. Since she deals with schizophrenia and depression we have to consider maybe those disorders had something to do with her agreement to sell the land for a low price of $54,000 (agricultural value) when in reality the real estate appraiser found that the real market value was $162,000 at the time of the contract. We don’t know for sure if Betty was intentionally trying to deceive Carr, but the contract was a steal for the Campbells if it went through.…

The defendant original wanted to sell a farm for £1000; however the claimant made a counter offer of £950. The Counter offer was not accepted so the claimant subsequently tried to accept the original offer. The defendant then refused to honour the original offer. The claimant bought an action of specific performance against the defendant, but was unsuccessful because as soon as a counter offer is made this immediately voids the original offer in its entirety (Duxbury 2011) and the offerer is not bound by the original offer. Nevertheless due to differentiation of interpretation of language and conduct, both potential outcomes must be analysed and then assessed which course of action would be most…

In this element, the offeror will give something in exchange for the promise which also part of the bargain and it must be real and tangible with actual value: White v Bluett (1853) and need not to be adequate: Thomas v Thomas (1842) (Fried 2015; Turner 2014). In most cases, consideration in return for a promise will constitute both benefit and detriment to both parties. There are certain scenarios where the promise does not constitute a valid consideration.…
