2. Explain what transpired in the initial meeting with the mediators. Our objective in the initial meeting with the disputants was to get each of the two sides brainstorming and communicating with us on how they felt about the issue and what they wanted to get out of this. We wanted to explain how mediations are run as a form of alternative dispute resolution. Our objective was to be as neutral as possible, our purpose was to usher each side to communicate about the issue what their approaches were in the upcoming mediation and what offers or suggestions they may have to the opposing side. We evaluated the role played by the disputants in the initial meetings by trying to get to the heart of each sides problem in their dispute and by listening to what each side wanted to gain and what they were willing to give, if anything. Overall, we tried to break down what the disputants were saying and then to infer how this relates to the opposing side, in order to try and evaluate how the mediation will go. I think so as we used many techniques highlighted in the book such as, positional bargaining, separating people from problems, looking for options for mutual gain and stressing the impotence of communication. I think there was room for improvement, but overall I know for myself the book guided me on how I wanted to guide the mediation and do so effectively and I think we did well using this strategies as they do work most of the time, as mentioned in “Getting to Yes”, and did so in our simulation. Using these strategies mentioned allowed to have meaningful discussion and effective options to try and solve the issue and understand an maintain the relationship of the opposing side. It prevented one from hard bargaining or from digging their heels in the sand. Everyone was cooperative and it proved
