The meaning of mens rea to me is the intention or knowledge of doing something wrong but not always doing it on purpose (Toney, 2009). Mens rea has some form of intent either general where the person made a conscious decision to commit a crime for whatever reason, specific intent, or negligence intent which in the case of the truck driver was negligence intent, he failed to use reasonable care or caution before he switched over into the other lane (Siegel, Schmalleger, and Worrall, 2014).

Yes, he should be convicted if the prosecutor uses the negligence intent because he failed to follow the rules of the road and checking your blind spot is a big issue when teaching truck drivers. It is a flaw that he may get off on it does not mention if
