Some of the procedures required for filing a discrimination lawsuit under the disparate impact and disparate treatment theories include an act of existence of disparity, the act of disparity that was caused by a specific employment device, policy or practice. It requires that the challenged disparate policy was not justified by the business necessity; and the less discrimination measures were available to the employer and would have served its needs well.
