Straus (2001) found that the use of inductive discipline, where discipline uses reasoning and explanation, provide more cognitive benefits to the child than corporal punishment. The cognitive benefits are the ability of children to learn and their motivation to learn. The definition given of cognition by Merriam-Webster is that cognition involves conscious mental activities which include thinking, learning, understanding and remembering. The arguments against capital punishment are that corporal punishment is legal child abuse and that it makes the student angry. Both the pro and con sides of the use of corporal punishment in the classroom agree that if teachers were better trained in how handle behavior problems, corporal punishment might not be necessary.
There is a question about how hard a student can be hit in public school. Some states prohibit “bodily injury”, while other states allow it. There are many lawsuits in court system that say corporal punishment has hurt the child severely. One such case is that of a Georgia boy in elementary school. The teacher punished him for not having his homework done, claimed the Atlanta Journal and Constitution. The teacher hit the boy once, but then grabbed him by the arm to hit him a second time. That is when the boy received a spinal fracture in his upper part of his arm. The boy received $10,000 in damages from the school
