I think that it could be possible for John to get out of the contract with Fred, if he is able to prove that he was indeed intoxicated while signing the paperwork. Of course this can be challenging to prove, without the help of witnesses, or other forms of physical proof that he was drinking the night before. For me if someone was drinking since the night before, to would seem or smell obvious that they were drinking.
