Warfield Criminal Conspiracy Case

The scenario discusses Warfield went along for a ride with a group of men who intended to kidnap the victim and her children in an attempt to commit robbery of her place of employment. In the scenario presented, the offenders were successful in entering the victim’s home and detaining the children and adult subject against their will. As they were leaving the house with the adult victim to rob her place of employment, they were noticed by the police in which all parties including Warfield fled and were apprehended. In this case, Warfield could be charged as an accomplice to criminal conspiracy, forcible entry, child endangerment, kidnapping, and attempted robbery. However, the scenario does not discuss Warfield’s association with the men, whether he went along “voluntarily”, and to what degree he participated. However, with the facts …show more content…
According to Lisa Storm, an individual’s presence at the scene combined with fleeing the scene is not enough to determine if the individual is an accomplice unless the person has the legal duty to act and fails to act applying liability as an accomplice [1]. Criminal intent is also required to determine accomplice liability in according to state law with regards to general intent, knowingly, specific intent, or purposely helping achieve the desired outcome. [2] If we assume that Warfield voluntarily went along for the ride, he was obviously aware (knowingly) when they entered and took the victims against their will that the act of doing so was a serious criminal act. We know he is aware what is happening is wrong but did he assist or do anything to help discourage the crime? If not, as an accomplice, Warfield has and equally responsible as the other subjects if he willingly went along in furthering the
