Walmart Observation

On the above date I responded to Walmart to back-up Sgt. Lush on a retail theft.

While inside of the store I was advised by Walmart Loss Prevention Officer, Chris Hoerl, that a White male subject, who stole from the store earlier in the day with Sgt. Lush's prisoner, was next to the deli. Hoerl led me to the subject and positively identified him. Hoerl even provided the subject's name, Jesse Zurfluh, which he obtained from Sgt. Lush's prisoner.

I made contact with the subject at the deli area who identified himself as, Jesse Evan Zurfluh. Hoerl again confirmed that he observed the defendant walk out of the store with stolen merchandise. I then detained the defendant in handcuffs and led him into the LP office.

While in the LP office I viewed the store's video surveillance, before any questioning took place. I confirmed LP's statement that the subject stole from the store. The subject is shown entering the store through the garden center empty handed. The subject is next observed selecting several items in different areas of the store before proceeding to customer service. The subject attempted to return the items unsuccessfully. Shortly after, the subject is observed exiting the store, beyond all points of sale, out of the GM side with the items in his hands. The subject was wearing the same clothes in the video as he was when I detained him.

The type of identification indicated in the scenario would be a showup, as only one individual was presented to the cashier just after the robbery occurred (Hall, 2015). A showup is extremely suggestive, therefore must be conducted with caution. The preferable method of identification would be a lineup, consequently, in some areas, this is not conducive due to time constraints. A showup identification process should only be utilized when the suspect is apprehended within a short period of time following an incident. In this scenario the cashier could indicate the suspect apprehended is the same individual who committed the robbery, conversely, the cashier could indicate their inability to make a positive identification.…
