Victorian Civil and Admisnitrative Tribuna (VCAT)l located at 55 King Street Melbourne. It is where disputes are resolved in a timely, cost effective and efficient way as their statement of vision state it. The personnel in VCAT were so kind and accomodating to us students. They welcome us with gladness when we introduce ourselves as student from Stotts College. The physical set up are good. It is very conducive to the atmosphere of resolving disputes. It is very private and cozy. We come to know that VCAT has several civil divisions which hears different civil disputes relating to consumer matters, domestic building works, legal services, owners corporation matters, retail tenancy disputes, sale and ownership of real property, and use or flow of water between properties. I have come to learn that there are also hearing of case outside this tribunal. …show more content…
It was stipulated in the contract that the tenant will pay the rent every 20th day of each month as it was agreed that the tenant will moved in during the 20th. However, tenant moved in on the 10th of the month since the house was already vacant at that time. Furthermore, tenant agreed to pay $320.00 per week. The agreed rent is 1347 but tenant was being charged $1390. The applicant tenant filed the case because she wanted to claim that she was being deceived that there was a breach of the contract since she said that she is supposed to pay her rent every 20th day of each month. To add, she claimed that she was being charged for $ 1390 instead of the agreed $ 1347 rent per month. So tenant refused to pay her rent for three weeks. The defendant showed evidence that the tenant was being informed of the monthly rent which is $1390. Emails were being sent and tenant agreed to the price adjustments. The tenant denied the e-mails and she did not understand the contract thoroughly because she was so tired to read all what she signed
