Throughout the years the amount of crimes leading to victim injury has risen and so has the level of victims participating in the criminal justice process. Victims have been able to share about their pain and suffering through victim impact statements, VIS, these are usually red by the victim right before sentencing. There are two points of view when it comes to VIS. Some believe that they have had a positive effect on sentencing and that they are also good for the victim’s personal wellbeing. While some others believe that the emotional reaction from the VIS has led to excessive sentencing. Something that was also taken into account is need for affect, NFA and need for cognition, NFC. Direct Victim: The direct victim in the case study is a factory manager who explains that he was shocked and horrified by the mess and damage from the crime. His financial losses were not only the cost of the damages, but also the loss of making money the entire day as the day was spent cleaning up the mess (Crosland, P., & Liebmann, M. 2003). Although the financial needs of the direct victim were not met because the offenders were young children and could not repay it; according to the victim motives for participation in our textbook, the victim’s emotional needs seem to have been met. Some of the needs that were met are holding the offender accountable (the offender took full responsibility for his part in the crime), learning…

Nils Christie wrote “Conflicts as Property” arguing the importance of conflicts in society and how they have become property that can be used and stolen. In this critical summary I will summarize and then critically analyze his work to determine if I agree with his argument. Christie opens the paper by arguing the importance of conflicts in our society and that “they ought to be used, and become useful, for those originally involved in the conflict.” He continues by describing how conflicts are taken from the victim, who “is so thoroughly represented that she or he of most of the proceedings is pushed completely out of the arena, reduced to the triggerer-off of the whole thing.” The author also denounces courts and lawyers that, he believes, are trained to steal, prevent, and solve conflicts.…

Restorative justice philosophies blossomed throughout the twentieth century as a response to various developments in the criminal justice system. More specifically, the lack of confidence in rehabilitation and deterrence tactics, increased recognition of victims as essential stakeholders, and heightened interests in community justice were trends that led to restorative practice (London, 2013). While Albert Eglash first mentioned the term “restorative justice” in the late 1980’s, scholars have failed to provide a concrete definition for this term (Van Ness & Strang, 2015). However, for the purpose of this research, restorative justice will be defined as an inclusive, collaborative process that embraces respect in order to collectively identify and address harms, needs, and obligations while…

The conventional way of punishing and processing offenders within the justice system has come under scrutiny for its many failings in repairing damage caused to the victims involved in a offence. The main limitation that has come under scrutiny is the role the victim plays within court proceedings, this is a major issue because the justice system fails to quell the harm of victims or provide the healing necessary for closure. Andrew Ashworth (2009) states that the changes within society has taken the power from the victim to bolster their own and in doing so has interrupted the ways of the natural world (Newburn, 2009 p.728). Furthermore due to the legal proceedings being adversarial in nature in most western societies the victims has less powers in addressing the offender or the court.…

While majority of toys are safe, some can pose serious risk for children. Regrettably, a majority of recalled products are in response to child related incidents; for instance, in 2014 an estimated 251,800 toy-related injuries were treated in emergency rooms nationwide-- 73% to children younger than 15 years of age while 34% were children younger than 5 years of age United States Consumer Product Safety Commission, 2015). Although recalls are a preventative measure in helping to prevent further harm or injury from a defective product, manufacturers and sellers of the product can still be held liable for negligence if that product injures a consumer. According to Seaquist (2012), negligence occurs when a person falls short of a reasonable…

Victimology Life Style Exposure The life style that the three victims, Byers, Branch and Moore had would have put them in minimal amounts of situations where they would be exposed to victimisation. As eight year old children they would have had School Monday to Friday, where they would have been overseen by a number of adults and be in the company of numerous children. This means that most days of the week and most hours of the day the victims would have had low risk of exposure to criminal behaviour. There is also little evidence to suggest domestic violence in the homes of the victims, as however, there is only Byer’s fathers transcript in the Case Materials (1993)…
