If you have ever been in an accident, and the other driver was at fault, you may have had to make a claim under the uninsured motorist or underinsured motorist provisions of your auto insurance policy. These stipulations of your policy come into action when the at-fault driver either has no insurance coverage, or inadequate insurance coverage, to pay for the injuries or property damage that occurred during your accident. Keep reading below for more information on how to deal with these types of claims.

What is Uninsured Motorist Coverage?
Uninsured motorist coverage is to help pay for medical bills that may occur or property damage expenses in the case that the at-fault party in the incident does not have any auto liability insurance. The “innocent third-party rule” no longer exists in Michigan — at least until the state Legislature decides to create one, the Michigan Court of Appeals has declared in Bazzi v Sentinel Ins Co (Docket No. 320518). As a result, innocent third parties — including medical providers who treat persons injured in car crashes — are not entitled to reimbursement for their services when a no-fault policy was allegedly obtained through fraud, although they were not involved in the purported fraudulent conduct. For more than 30 years, the innocent third-party rule has allowed third parties, such as medical providers, to collect PIP benefits, even if the insured had fraudulently purchased the no-fault policy. But according to the Court of Appeals in…

This means that your insurance company must cover your medical expense and lost income even when the other person is at fault. The only way the other driver may have to pay for the costs is if there is a serious injury.
