When a person is accused of a crime and found guilty, it’s the court’s job to make a verdict of their sentencing. At times those sentencings aren’t exactly the appropriate for the crime the person is being accused of or committed. I believe it’s only fair that regardless of race, ethnicity, illness etc. that everyone who breaks the law by committing a similar crime should receive the same sentencing time.
According to the website ACLU many people are currently in prison serving “… decades long…” sentences that don’t equal up to the crime they committed (ACLU.org). Some cases go as far as a person facing life in person without parole and this is for only nonviolent crimes. The CLRP wants to put an end to these unfair sentencings, they want

People of color are not treated equally when it comes to jail time. African Americans serve as much time in prison for a drug offense as whites do for a violent offense. Drug offenses and violent offenses are two very different things, yet they are treated the same when it comes to race. But even after jail about 95 percent return to drug abuse after…

“The death penalty continuously falls disproportionately on racial minorities.” (Frank Schmalleger) For instance, when criminals murder whites they are more likely to be sentenced to death than are those who murder blacks. The death penalty should never be influenced by arbitrary and unfair circumstances if the government were upholding it, and since we are only human that is inevitable. For example, in the case of the Boston bombing; Dzhokhar Tsarnaev, had been sentenced to death, but it may have been solely because his case was has held at the same location, Boston, as the…

In the article, by Engen (2003), authors argue that structural features of guidelines not only serve as "windows of discretion" through which disparities may arise, but they may encourage disparities by requiring consideration of substantive criteria that disadvantage certain offender groups. It is important to understand that sentencing disparities are active under the current guidelines. Mainly because discretionary rulings are used in ways that disadvantage minority groups (Albonetti, 1997, 1998; Kramer and Steffens Meier, 1993; Kramer and Ulmer, 1996; Steffens Meier et al., 1993; Steffens Meier and Demuth, 2000; Ulmer,…

According to The Yale Law Journal article titled, “Mandatory Sentencing and Racial Disparity: Assessing the Role of Prosecutors and the Effects of Booker,” by Sonja Starr and M. Marit Rehavi. In the Supreme Court case, United States v. Booker, regarding sentencing guidelines, a federal district court judge enhanced Booker’s sentence based on the facts the judge determined. Booker appealed the enhancement as in violation of his Sixth Amendment rights. In another case, according to sentencing guidelines. Because of this case, it is in violation of the Sixth Amendment right to a trial by jury to allow a judge to enhance a sentence using facts not reviewed by the jury (Starr & Rehavi, 2013).…

Aaron I think it's cool you picked Idaho. To be honest I here about Idaho constantly living in Montana I'm glad you gave some incite in on the sentencing guidelines for the state of Idaho. I also read the Idaho I was thinking of doing my post on Idaho as well, and I read according to U.S. Probation & pretrial District of Idaho (2014), "The Sentencing Reform Act of 1984 radically changed the philosophical model for sentencing offenders in the Federal Courts" (p. 1). After this occurred congress adopted a determinate based off of national guidelines. Which lead to the supreme court in 2005 ruling in the"United States v. Booker, 125 S.Ct.…

I believe some people are not given a fair sentence. How was it that Ethan Couch a white teenager was able to remain a free person in the world after committing a crime and killing 4 innocent people , but as soon as a similar situation happened to Jahmar James an African American, the sentence has changed and he wasn't a free man. This definitely was eye opening to me and made me aware that racial discrimination is occurring in courtrooms. This was only comparing two cases , I can only imagine how many other cases there are in America that continues to give advantage to some people simply because of their skin color or social…

The system just isn't equal for races, the criminal justice system was creating by whites and they focused all of it on them and didn't really give any fair rights to the black and hispanic race. “ Hispanics are overrepresented in the nation’s criminal justice system, with Hispanic defendants imprisoned three times as often and detained before trial for first-time offenses almost twice as often as whites, despite being the least likely of all ethnic groups to have a criminal history, a report released today has found.” separating the guilty from the innocent and protecting against injustice. “It is apparent that the criminal justice system in this country is neither fair nor just for Hispanics,” said Janet Murguia, NCLRs executive director and chief operating officer. “Recent polls show that Latinos care very much about protecting public safety and fighting crime, but they recognize that being tough on crime is not always the same as being smart on crime.…

The most plausible reason for racial disparities regarding sentencing is that minorities “are more likely to be subject to facially neutral laws and policies that prescribe more severe sentences or sentence enhancements” (Walker, Spohn and Delone 2012:286). For example, police patrols in a minority-housing complex on one shift disregard anyone with a joint or two when they search an individual. Occasionally they may write a summons to court therefore the residents get comfortable that they have that leeway. Then as the next shift arrives, after leaving a domestic disturbance where they had a standoff with a suspect. Even though they may have diffused a potentially dangerous situation, they arrive supercharged with adrenaline, angry, and in a status of hypervigilance.…

As it says in the last paragraph of the Heather Mac Donald article says “black prison rates result from crime not racism.”. The other side says that the justice system is biased to African Americans, they say “black Americans are more likely to serve longer sentences than white Americans for the same crime. Black American are also more likely to have their cars searched I believe that the Justice system does not look at race when in a case.…
