Some people might use this as a reason to quit, but some would use this to stay because they wouldn’t want the soldiers to die in vain. A soldier would be abandoning his friends if he left. In document C it talks about the awful experiences soldier had to go through. If a soldier just left then he would have suffered for nothing. A soldier would be abandoning his country if he left just because he was scared.…
Hello your honor, members of the jury. I am Marim Ibrahim and I will be representing the accused, in the case of Her Majesty the Queen against Wally Brogue. My defendant has been accused of committing first degree murder in the death of Mr. David Bennings on July 14th 2013. This is the case of a caring, optimistic man who simply wanted to do the right thing. Mr.Brogue did not commit this crime.…
Introduction For our seventh lesson in Portfolio Milestone I am choosing to explore Option # 2: Developing a defense for Richard based on facts, his age at the time of the offense, and state of mind during the offense. How he may have been better off with a jury trial. My original thoughts were that Richard was highly intelligent, articulate and should have known better. After further study I am thinking to some extent the system failed Richard and other youths in similar cases.…
CASE SUMMARY “Hannah Leflar's teenage killer sentenced as an adult to life in prison” by Alex Soloducha, discusses the tragic murder of a teen girl in Regina, Saskatchewan. In January of 2015, Skylar Prockner murdered Hannah Leflar by stabbing her multiple times. 16 at the time, the teen had become furious when he learned that his former girlfriend had started dating someone new (Soloducha, 2017). Typically in a case involving a young offender, the name of the convicted criminal would not be released, as per the Youth Criminal Justice Act. Unfortunately for Prockner, he received an adult sentence for the murder.…
What he has done will not necessarily make people look at him like a mad criminal, which will help in reintegrating him back into society. Conditions of his discharge will be, attending school everyday until he finishes, being home at 8pm on weekdays, 9pm on weekends, and not being able to be with his band,…
The news Headlines today are blowing up with the craziest stories “Boy Charged with killing 8-year old girl over the argument about puppies” (ABC news). Kids are being convicted of murder and tried as adults but they are juveniles so the question is “What is the fine line between intentional and unintentional killing?” The difference between being tried as adult and being tried as a juvenile? How does the justice system treat those with mental disorders? In Just Mercy, written by Bryan Stevenson there were many cases of children committing crimes that involve murder and are sent to death row, or imprisonment without parole.…
This case changed my outlook far as execution of juveniles. This case involved Simmons a young man that had a murder charge. I feel at age 17 you should be aware of our actions and with the fact that he bragged about the killing was an eye-opener to think of the possibility that this individual could have had mental issues or suffered some type of abuse as a youngster, that may have caused him to carry out this act of violence. I don’t feel he should have been executed due to these possibilities; however, a tough sentence should have been enacted. This case changed the development of sentencing anyone under the age of 18 to death it was ruled cruel and usual punishment.…
Truman Capote revisits the 1959 Holcomb, Kansas, tragedy and recreates the surrounding of the monstrous Clutter murders in his contentious non-fiction novel, In Cold Blood, along with that, he recalls extensive the manhunt and trials that followed. Capote wrote the book to demonstrate, what he views as, the “cold-blooded” cruelty of the death penalty in the United States. However, opposite to Capote’s intentions, through his long attempt to argue against capital punishment as the severest form of a criminal 's sentence, Capote’s shown empathy towards any murderer, not just that of Perry Smith and Richard Hickock, actually works towards his stance’s demise once he shifts the novel’s concentration to the Kansas State Penitentiary for Men’s…
Juvenile Transfer Laws Alonza Thomas was a 15 year old teenager with no prior convictions or a record. He decided to run away from home and found himself staying with someone he thought he could trust. Unfortunately, the man he was staying with demanded that Thomas was to rob a gas station to pay him back in return for staying in his house and eating his food. The man supplied Thomas with a loaded gun to rob a gas station.…
While the “criminal is a child” approach to the juvenile justice system is appealing due to its forgiving nature and emphasis on rehabilitation rather than punishment, there are some cases in which this decision is not so cut-and-dry. One of these instances of a legal “gray area” is the case of Marin Sinzer, who was charged for the murder of Tammy Shevin, 25 years after the crime was committed. The now 38 year old is petitioning to be tried as a juvenile, since he was only 13 at the time of the crime, a year younger than the waiver age at the time. While many proponents of the “criminal is a child” approach take that stance because of the physical and psychological dangers posed to juveniles who are placed in adult prisons, in this unique…
Discuss the issues involved in premature termination of treatment. When is such an action justified? Discuss the ethical and legal implications of abandoning a patient. There issues involved in premature termination of treatment that can lead to legal action for the physician if he chooses to terminate the patient’s treatment. It can also cause harm or in some cases death if the treatment was not completed.…
When the young offender was fourteen, he was arrested,…
Ian was told to plead guilty to attempted homicide. The judge proceeded to sentence the thirteen year old boy life in prison. The prison decided that the best thing for Ian was to be put into solitary confinement where he was sectioned off from any other inmates and the prison workers that threatened him with abuse or sexual assault. “A teacher who had been confined in the facility when she was a teenager confided to us that she had been sexually assaulted by a staff member who was still in our employ years later.” (“What Mass Incarceration Looks Like for Juveniles”…
Children are usually seen as innocent, as they play around with others and are just balls of energy. Often seen as simply kids who have no experience in the outside world until they grow older. However, sometimes a child’s play can go wrong and can affect another’s life. When these incidents happen where a death is involved, it’s often easy for society to look at the offender as a murder who should be in prison for the rest of their life despite what age the offender may be. While juveniles committing heinous crimes should be punished, they should also be given the chance to rejoin society at an appropriate age; therefore juveniles who redeem themselves should be able to get released earlier and be able to put their life together.…
There’s a saying to never judge someone by their past mistakes but to look at their actions now, and so forth. I don’t believe in that for killers. Yes, they probably feel awful about it now that their victim is no longer alive, but it was their choice to do it. Fredrick Baer could have had a mental disease, could have. Nonetheless, he was withdrawing off meth which means he was a drug addict.…
