However, we are bullying and persecuting the transgender community which causes them to be unsafe from us. Rather than address these issues head on, policy makers and employers want to make specific bathrooms for transgender people. This again, is a privacy violation. Court decisions in this country have even supported the rights of an employer to dictate what bathroom an employee should use. “For example, the court in Etsitty held that an employer's dismissal of a preoperative male-to-female transsexual was permissible because the employer was not forcing the plaintiff to change her appearance, but rather to abide by societal delineations of permissible bathroom facilities”. Bathroom policies such as these put the wants of the majority ahead of the needs and rights of the transgender minority. How can those in government make the claim that the rights of a certain group of people are not as important as the rights of others? Particularly when their decisions support the fears or prejudices of that majority group, rather than attempting to bridge the gap and promote tolerance. Decisions such as these only serve to deepen the distinction between the transgender community and others in society. On the one hand, people recommend creating a third option for bathrooms that will allow transgender people to have their own bathrooms. In theory, this will not make people uncomfortable who may not wish to share bathrooms with transgender people. On the other hand, however, this is not recommended because it will force transgender people to out themselves and it may cause them to be looked at differently. There are many people who may prefer to keep their transgender status private, and outing them by forcing them to use specific bathrooms is not fair. Similarly, policymakers have suggested keeping women’s bathrooms the same but converting men’s bathrooms into gender neutral bathrooms. However, this is not a proper tactic. People should be able to use their bathrooms based on gender identity, not the gender assigned to them at birth. They should be able to live their lives as they choose, including going to the bathroom in an environment in which they feel most
