Foster v. Chatman Late 1980s a young man named Timothy Tyrone Foster, age 18 black African-Americans was charged with the murder of a white elderly woman named Queen White. During the court-martial, the persecuting attorney decided to use his Peremptory Strikes to remove all four black jurors. The prosecutor violates the race-neutral acts, the members of the jury pool used extreme strategy against the race matching of the defendant. Under the Supreme Court’s decision in Batson v. Kentucky, it does not let to use an unconditional attack that defines as a racial discrimination, but they remove any burden they may affect the case so they can give him a fair trial by using legal racially biased jury selection method. At the end, Tyrone Foster was sentenced to the death penalty for the murder he convicted by all the white jury.…
Justice is widely known as being blind, but this can hinder justice’s ability to provide effective judgement. Eli Ashpence once said, “A blind justice is merely an impartial justice. True justice would have eyes in the back of her head and a pair of mismatched shoes.” (Ashpence 2015) Just like Eli, I believe that to serve true justice, the situation and past of the criminal should be taken into consideration, because often, situations are not as black and white as they seem.…
In a real-life trial within a courtroom, there are two sides: the plaintiff and defense. The plaintiff’s role is to prosecute the defendant with a crime, and the defense’s role is to vindicate the defendant of the crime accused. To do so, a story must be told, followed by an argument with evidence as aid. The person in charge of the final verdict is the judge or the jury. In the book, Just Mercy by Bryan Stevenson, the readers become the jury and Stevenson is the lawyer who is presenting the injustice within the case of Walter McMillian.…
Justice is just the behavior or a treatment. In the novel the uglies, the main chacternamed Tally was in some significant way to justice. In the way that when Tally was young she had always wanted to be a “pretty” and more to the other town with all the others because that's was the usual plan for everyone in ugly town. As tallys best friend was a year older than her, tally was upset when her only best friend left to became a pretty and start a new life in the other town. Tally had broken the law one night to go see her best friend, because an ugly can never enter pretty town until they undergo the process.…
I was shocked to hear of these behaviors that occur in courtrooms. I have never had to go to court but I would be appalled to see judges and attorneys acting in those manners. Although this is not everything discussed in chapter one, it is the main ideas and the ones that truly shocked me and stood out to me. The second chapter, Gonzalez Van Cleve leads off with discussing that although criminal courts claim to be “color blind,” they still treat the defendants as lower class individuals who deserve nothing than the worst punishment. In cases where crimes were committed in self-defense, this is particularly harmful because the defendants are still treated as heartless criminals even though they were simply trying to escape a dangerous situation.…
However, the jury is not a democracy. The jury reaches a verdict based only on evidence provided to them during the trial. Additionally, the trial aggravated a vast misunderstanding of the defense counsel’s role, a problem present before the case.…
“Richard II”: Through “Richard II”, Shakespeare describes the transition from a medieval conception, the aristocracy, in which the King is seen as the “prince”, in the latin meaning of it: primus inter pares, first among equals. It can be stated that the king is a sort of an elevated duke, who people need for military purposes, for the necessity to be protected (Lecture 10/01). Thus, he is bound to the law: with the sign of the Magna Charta the aristocrats have forced the King to recognize the legal limit to his power. The play opens with a trial, performed in a very static, excessively serious way, so that this type of beginning would have led the audience to abandon the theater.…
In a country like the United States the power of the government is divided among three branches; the legislature, the Judiciary and the executive. Out of the three, the Judiciary branch is responsible for interpreting and applying the laws made by the government. Our Judicial system comprises of courts that administer justice in the name of the state. The Judiciary is meant to ensure equal justice under the law, but the poor and minorities groups seem to suffer in our judicial system. As mentioned in the book, Just Mercy by Bryan Stevenson, minorities mostly suffer due to injustices like racial profiling and flexible sentencing.…

In addition, sometimes people that are involved in the case can be famous or well known. This could lead to threats because if the person is really powerful, he/she would threaten the judge. If it was a jury, it would be hard to threaten because you will not know who the citizens are in the jury until you walk into the court room. For example, Zenger printed a newspaper critical of the British…
A Murder on a Sunday Morning is a documentary that follows the trial of 15 year old Brenton Butler in order to prove his innocence by displaying the ethical issues behind the case. Brenton Butler was accused for murdering Maryann Stephens who was walking with her husband to their hotel room after breakfast, when he supposedly approached Ms. Stephens and demanded for her purse at gun point, then proceeded to lift his gun and shot her in the face, leaving Mr. Stephens as the eye witness to the crime. When questioned by detectives, Mr. Stephens describes the shooter to be a tall, skinny built black male wearing a dark shirt and shorts, and a fishing hat. Police who were surveying the area spotted Brenton Butler who coincidentally fit the description. Brenton, who was on his way to apply at a local Blockbuster store was told by police of a murder that happened nearby, and was asked to go to the police station to answer questions about what he may have seen; however, the 15 year old ended up in the back of a…
The justice system of America is constantly criticized for being unfair. The establishment of an unfair justice system is due to bias and bigotry. The play Twelve Angry Men by Reginald Rose shows the prejudices of the system as twelve different men, from different past, must concur and make a verdict on a murder case. The author indicates that the justice system is unfair through biases portrayed in the juror’s dialogue, past history, and attitude in making a verdict.…
With the help of the villagers, Blair was able to research the life story about the brothel boy, along with the crime he committed. The Brothel Boy is far from a boy, as he is roughly twenty or so years old, who was born and raised in the Brothel. He was the son of a woman who worked in the brothel as a prostitute, but died shortly after the boy’s birth, and a man who was unknown. Therefore, the brothel keeper took him in to raise him. It was extremely apparent that the boy was uneducated and retarded, “The boy was obviously stupid.”…
Justice is a term that people use to describe as an act or behavior that represents the good people present to others and themselves. It serves as a moral high ground that people strive to be, although sometimes these thoughts can be twisted into its opposite and cause pain, anger, and other negative emotions and acts arise within people. This pain erupts into what is known as injustice and is the epitome of what people should not strive for due it bringing so much negativity. It is a moral choice that no one what’s to make due to the label that it puts on them making them into monsters in the eyes of others due to what they believe could have been done. Although, in some cases, injustice is sometimes the best choice in the matter if one is…
After reading a novel such as Atonement, one is forced to question oneself, one’s past mistakes, what one did in an attempt to right one’s wrongdoings and whether or not one’s efforts will be enough. Guilt and regret can often fill oneself after making such mistake and in an effort to rid oneself of the guilt, often an apology is made to the one the wrongdoing was made against. However, amendments are not always enough; apologies do not erase scars and often times, not even the guilt from the committed sin can be washed away completely. Briony Tallis herself struggled her entire life with not only the internal guilt she felt but the desire to atone her mistake with her sister. In the flash of a moment, Briony does not realize that her actions…
