The contentious debate over New South Wales government’s decisions to introduce new lockout laws has been heating over the past months. However, amidst the disagreement, Kings Cross has seen a 32 percent reduction in assaults since the laws were passed, while assaults in the Sydney CBD have fallen 26 percent according to the Bureau of Crime Statistics and Research (BOCSAR). The NSW Government has introduced new laws that close Sydney’s music clubs to new guests at 1:30am and ban selling alcoholic drinks after 3am. The legislation was passed two years ago by the state government, following a number of high-profile assault cases including Daniel Christie one-punch killing. The authorized law aims to restrain further alcohol-fuelled violence for …show more content…
The lockout laws have mainly affected the entertainment district which stretches across the Sydney CBD, Surry Hills, Darlinghurst, the Rocks, Kings Cross and Cockle Bay. In the 6 months since the laws came into effect, there have only been 2 incidents of assault, compared to 22 in the same period last year, states Police Assistant Commissioner Michael Fuller. Perhaps the strongest justification for lockout laws comes from Deakin University professor Peter Miller, who notes that “Alcohol-related harm increased by 20 percent each hour after midnight, which he said made a strong case for closing venues at 3am.” St Vincent 's Health Australia have seen reduced pressure on medical teams in emergency rooms and NSW emergency service workers have also written to Premier Mike Baird urging him to keep the laws in place. They said repealing the laws would turn back to those days when local streets and emergency departments were full of victims of alcohol-fuelled …show more content…
In 2012, Kelly was 18 he was walking down the street in Kings Cross with his girlfriend and struck unexpectedly by a fatal blow and was killed. In 2013, Christie, who was also 18, was killed by Shaun McNeil, a belligerently drunk MMA fighter, as Christie was trying to get McNeil to stop attacking a group of teenagers when he was punched, fell and hit his head on the ground, leading to serious head trauma. The death of Daniel Christie stimulated a prevalent debate on alcohol-fuelled violence and ultimately led the state government to introduce a suite of measures including 1.30am lockouts, a ban on takeaway alcohol after 10pm, 3am last drinks and a freeze on new liquor licenses. Those found to be violating the laws can sustain penalties such as fines up to $11,000 or imprisonment of up to 12 months. Michael Christie, the father of Kings Cross king-hit victim, has spoken up in the public about the lockout laws that were constituted following the death of his son. Michael Christie says that while he supports the idea of the legislation but he has "a lot of disgust" that former NSW Premier Barry O 'Farrell never conferred the laws with him prior to their enactment as

According to the Court of Appeal of Ontario, sentences for fatal drinking and driving cases have turned towards harsher penalties recently. In Prosa’s case, Hainey felt that he was a good candidate for rehabilitation who would most likely avoid offending again. After Hainey’s decision, Brian and Antonette Wijernatne, the other members of the Wijernatne family, expressed their dissatisfaction with the penalties drunk drivers face. The Crown prosecutor, Tom Goddard offered a similar opinion- adding the repercussions that come with drunk driving. Premier Kathleen Wynne of Queen’s Park, stated that the government was willing and ready to enforce harsher penalties for drunk driving as soon as it grew in demand by the general…

The California Three Strikes Law has contributed to the increase in prison population. The increased prison population has become so bad that the state was ordered by the Supreme Court to release prisoners to avoid a violation of the Constitution for cruel and unusual punishment in reference to overcrowding their prisons. A result of the California Three Strikes Law and the ideology of mass imprisonment subsequently led to the incarceration of non-violent less-serious offenders that were prosecuted primarily on possession charges. Mandatory sentencing laws and policies provide little to no discretion in regards to enforcement.…

The introduction of the mandatory sentencing in NSW was the outcome of several brutal crimes. The act is projected to measure alcohol and drug fuelled violence in several parts of Sydney and NSW. It is believed the institution will strongly deter others from these violent outbursts that killed and severely injured several teenagers and adults around Sydney. These incidents were nationally viewed and sparked the people into action after Thomas Kelly was murdered in a king hit attack by killer Kieran Loveridge escaping on the very light charge of six years for the killing of an innocent teen. The alleged measures of this new legislation will…

A recent study has found that ‘One Punch Assaults’ have cost 90 Australian lives since 2000, most fuelled by drugs and alcohol abuse. Due to the increase in Youth Violence, Queensland’s Newman Government, as part of its Safe Night Out Legislation Amendment Act, 2014 has introduced the offence of ‘Unlawful Striking causing death.’ This recently developed law has a tougher penalty than manslaughter because it eliminates certain defences that are available under the charge of manslaughter. In the Criminal Code 1899, (QLD) Section 314A states that for the offence of Unlawful striking causing death, the prosecution must prove beyond reasonable doubt that the defendant unlawfully struck another person to the head or neck and caused the death…

The three strikes law was enacted in 1994 and has made some impact on crime and the way the criminal justice agencies relate to that impact. The three strikes law has both a good and bad impact on the criminal justice system. On the one hand, it helps to get the dangerous violet felons off the street and make the streets safer for the public. Emmitt Smith High School should Continue the Policy The National Center for Education Statistics states that 94% of schools have a zero-tolerance policy for weapons or firearms, and 87% for alcohol, while only 79% report mandatory suspensions or expulsions for violence or tobacco. These numbers are jaw dropping, because almost 100% of schools in the nation have a zero-tolerance a policy. Knowing these statistics, the administration at Emmitt Smith High School should push to have the current policy continue. Thought the policy has been said to be controversial, with some arguing that it violates the student’s rights, it can be disproved with the results of the surveys taken by the student body at this school.…

The effectiveness of an ADVO depends on compliance with the order, the willingness of the victim to report any breaches to the police and the active policing of ADVOs. For offenders, the notion of a ‘piece of paper’ does not always prevent them from committing violence when they are determined to do so. The issue of an ADVO may also increase potential violence due to the resentment felt by the offender. As displayed in the case of Luke Batty, (The Nice House, 2015) whom his father publicly murdered even after a Victorian equivalent of an ADVO was issued. His father was the subject of four arrest warrants, was facing 11 criminal charges and evaded police but was still granted access to Luke in public when he was playing sport.…

In 1996 the mass killing of 35 people at Port Arthur led to Australia’s government deciding to induce radical changes in gun control. The result of this decision was to implement the strictest firearm control polices the country had ever seen, and to remove nearly all guns from civilian hands. Australia implemented a buy back policy in which all firearms were demanded to be turned into the police and citizens would be reimbursed. In total 643,726 firearms were turned in by Australian citizens which were subsequently destroyed by police forces. After the forced turn-in of all firearms strict polices were induced in order to control those who still had weapons.…

“Law in Action” While three strikes laws provided high hopes for many states, especially California, in controlling crime through deterrence and incapacitation, these laws produced many conflicting outcomes and consequences. As a means to better understand the actual application of these laws, the following will provide empirical research on the various impacts that three strikes had on crime, prisons, local and state criminal justice systems, and the public. While presenting both, positive and negative aspects of these laws, particular focus remains on the adverse outcomes associated with the implementation of three strikes laws. Binge drinking is defined as “consuming large quantities of alcohol in a single session with the intention of getting drunk” (Youth Central, 2014). This usually means five or more standard drinks for men and four or more drinks for women. Standard drink in Australia is defined as containing 10 grams of pure alcohol, and for example one can of mid-strength beer, a 100ml glass of wine or a 30ml shot of spirits is one standard drink (National Health and Medical Research Council, 2015). Many young people do not understand the dangers of alcohol, and according to the 2007 National Drug Strategy Household Survey, more than 20% of 14-19 year olds drink alcohol on a weekly basis. Research has shown that alcohol affects teenagers ' developing brain…
