Republican politicians who support the ban argue there’s a “facially legitimate” reason for the policy, since Congress and the Obama administration have previously labeled the seven nations as “countries of concern.” Congress members in favor of the ban, such as Senator Steve Daines, believe Trump is using his fair use of plenary power under the circumstance that citizens feel threatened by potential terrorism. Lawyers also claim the executive order follows the Immigration and Nationality Act, which allows the President to “ban any alien or class of aliens” from the country. However, politicians on the opposing side point out the Immigration Act states the President cannot prevent someone from obtaining their visa based on “the person’s race, sex, nationality, place of birth, or place of residence.” The Immigration Ban would violate the Immigration Act along with the Religious Freedom Restoration Act that protects the right of people to freely exercise their religion. This leads Americans to conclude that Trump is denying entrance to our country out of discrimination. Since Trump initially called the executive order a “Muslim Ban” in his campaign, the idea is not far fetched. Statistics posted by theatlantic.com prove, “Nationals of the seven countries singled out by Trump have killed zero people in terrorist attacks on U.S. soil between 1975 and 2015”(Friedman, “Where America’s Terrorists Actually Come From”). Hundreds of U.S diplomats agree there is no threat from the residents of the seven countries. Overall, Trump’s Immigration ban is radical, unconstitutional, and an act of discrimination.
