A jury may also exercise the sentencing guidelines are usually imposed by the judge in most cases, but sentencing or it can be mandated by a statue; such as, mandatory prison sentence for certain crimes. There are various forms of sentences that are to be reviewed: concurrent and consecutive sentences, good time, sentencing sanctions, sentencing models, indeterminate sentences, determine sentences, structured sentences, feral sentencing guidelines, mandatory minimum sentences, and that of the three-strikes laws. The issue with concurrent and consecutive sentences is that concurrent sentences allow for than one sentence to be served at the same time as the others, while consecutive sentences only allow for one sentence to be served at a time, this is good in the case that there…
This week’s readings introduced many aspects of crime that touch closer to home. Many students may be reading this same textbook, though I expect that we relate to these topics differently, some grasp our attention more and others, standing to be more significant to our lives and fears. This week we were introduced to the economic repercussions of crimes along with the fear of knowing that some serial murders are so cunning that they simply seem to disappear. The reason many types of physical crimes are more feared for some individuals is the simple fact that it takes work to earn the things they chose to purchase.…
Compassionate criminal justice focuses on the offender more so than society. However this does not mean that the society’s or public’s needs are ignored. I think focusing more on the offender is a great way to stop the criminal from committing the crime again and possibly to give insight on how to prevent other offenders. Through process of rehabilitation we give offenders the possibility of another chance. Out of all four models; mechanical, authoritarian, compassionate, and participatory, I think compassionate is one of the more effective ones.…
Chapter 3 of the book The Art of the Con: Avoiding Offender Manipulation does a great job of describing the ways in which inmates spend their time during their prison sentences. Inmates use this time much differently. They adapt, cope, and meet their needs much differently as well. They are so accustomed to their lifestyles out of prison so they must do these things to stay sane. Inmates must quickly decide how they are going to spend their time in prison.…
I am writing this letter requesting you vote in favor of the Smarter Sentencing Act. Sentences regarding possession and trafficking of controlled substances are due for much needed review. Taxpayers spend several thousand dollars to hold a single inmate in prison for a year, and there are thousands of individuals currently incarcerated for such offenses. By essentially halving the minimum sentence of these crimes the billions of taxpayer dollars saved can be applied elsewhere.…
The United States being the largest incarcerate in the world is home of many elderly individuals, which I believe they should not be left incarcerated. The reason for this is because the cost to house an elderly person in prison is too high, and a lot of the elderly population is seriously ill, or even have cancer. Which then require to get a lot of medical attention. Elderly individuals being incarcerated may, or have faced many difficulties adjusting to prison life. Adjusting can be much more difficult for those who suffer from any type of physical or mental illnesses.…
Felon Laws and Recidivism When an offender is convicted of a felony he or she must be punished. This retribution not only included serving prison time, but fines and revocations. This subject is significant because we live in a culture where prisons are congested and crime is going up. The laws should be designed to support techniques in place that deter returning to prison and contradict them.…
The system should take a second look at not making those have to register as a sex offender if the offender and the victim end up married with children. There are some cases that involve 2 individuals dating without the parent's approval and one has to suffer due to the parent's being the ones to press charges. Consequently, the older individual has to end up as a registered sex offender. The registry for those who end up married should be null and void. Those are the types of situations that shouldn't have to suffer the maltreatment from the community because they do not present any danger or harm.…
On December 23,2009, 11 year old Sarah Haley Foxwell was snatched by a nighttime intruder from her home in Wicomico County, Maryland. A convicted sex offender, Thomas Leggs Jr was the intruder who kidnapped Sarah. He brutally raped her, and then murdered her and then burned her lifeless body in a field near the Maryland- Delaware border. Sarah’s body was found on Christmas day, Leggs was registered as a “high risk” sex offender. After that situation Leggs was deemed to be “compliant” in Maryland.…
Throughout this year we have utilized our own personal experiences, theories from the reading, and a multitude of theories and facts. Each of these aids us in the pursuit of understanding our justice system and how it treats or cares for the offenders that attempt to break it. The state of Texas, known for its odd and harsh punishments for offenders of all ages, uses a unique and complex sentencing structure reserved for its most violent and serious juvenile offenders. Determinate Sentencing is legally defined as a jail or prison sentence that is definite and not subject to review by a parole board or other agency.…
Criminals get released just to be incarcerated into society. Mass incarceration is not the solution to reducing or stopping crime. No matter how many people are put behind bars, crime is still going to happen. If jails and prisons are supposed to resolve crime, why does crime keep on happening? Penitentiaries ruin felons’ lives.…
There has been a widely talked about debate in the United States centering around the incarceration problem. The budget has been farmost the most talked issue including the quality of life for the inmates. Two theories have been specifically been discussed: rehabilitation and deterrence. Deterrence has been the leading theory for the twenty years, in the past decade some views have been shifted to rehabilitation. Evidence from the Department of Justice have backed these claims with shifting towards rehabilitation.…
The typology of tyrannical offenders can be identified in an individual who uses violence, aggression, intimidation, and physical and mental abuse as a justification when trying to manipulate and control their partner. In chapter 8, we observed how Sam consciously used violence and intimidation towards Beth towards the middle of the night, because he knew that Beth worked during the nights. Beth explains “Towards the middle of the night, Sam would wake me up beating my breast and forcing sexual intercourse.” In addition, when Beth tried to excuse his violence by stating that Beth was the one who provoked him by saying “I can’t get off you unless I hurt you.” Moreover, Sam inflicted humiliation every time Beth was trying to be independent in order to control her, for example, Beth stated “You look…
A juvenile, who commits a sexual crime, may have to register as a sex offender no matter what age they are. When it comes to registering a young criminal as a sex offender, it has it’s pros and cons. The first reason why requiring a juvenile to become a sex offender is to keep the community wary about their neighbors (Reddington and Kreisel, 2009). Those who move into a new area would like to know whether or not there’s potential danger in the area. Even if the sex offender is 13 years of age, I believe there could still be a danger to the society, especially if there’s a newborn or a preschool student moving in the same area as well.…
There are a lot of challenges that face those individuals who are or have been under the supervision of the Department of Corrections. It is very imperative to note the importance of employment on recidivism rates of offenders. However, the U.S. economy is additionally affected by offenders and their employment rate. A study conducted in 2010 on ex-offenders and the labor marker found that having a felony conviction cause a significant reduction in an individual’s employment rate.…
