One suggestion was punching a pillow or punching bag which can release tension. Another suggestion was to find something to smile about. It may sound silly but there are studies that show that smiling, even when you do not feel like it has positive physiological and psychological benefits. Being diagnosed with clinical depression I was skeptical about talk therapy until I found that there is very little difference in mild cases between medication, placebo and cognitive restructuring like talk therapy. The language that has been drafted (please see PD3134 PDF) is based off the legislation that has been adopted in 10 other states, with the addition of language that will allow Indiana to pursue additional grant money provided by the federal government through the Justice for Victim of Trafficking Act of 2015. This allows the United States Attorney General to allot grant money to states that have this language adopted. The provisions that many have expressed concern about is the language prohibiting a parent who is at least 18 years of age at the time the act of rape occurred from filing a petition more than 180 days after the birth of the child. This language was worked out with the Indiana Prosecuting Attorneys Council (IPAC) for the purpose to prevent concern of using this in an event of a custody battle later on.…

The Current State of Spousal Rape A driver’s license permits one to drive a car, a fishing license allows one to fish in certain bodies of water, and a real estate license authorizes an individual to represent a buyer or seller in the exchange of real estate property. In general, having a license gives the holder certain additional privileges that may have been punishable had the license not been obtained. Yet, this is not always the case, as evident in the results of the 1983 case of People v. Liberta. In an opinion about the case, Judge Sol Wachtler stated, “A marriage license should not be viewed as a license for a husband to forcibly rape his wife with impunity” (Margolick).…

Discussions about the age of consent laws are not common but it is important to show the truth about how these laws affect a modern generation of underage teenagers. Most adults think of teenagers as unable to give their consent to have sex and although there are safety risks for unprepared teens, lowering the age of consent in California from eighteen years to sixteen would benefit the teenagers and the state in the long run. In order to lower the age of consent, it is crucial to first understand the laws, give teenagers proper sex education and take a look at how it affects everyone and how the potential changes could improve the lives of teenagers. On the other hand, changing the age of consent laws could mean trouble for the unprepared…

Indecent assault and crimes of rape were replaced by new sexual assault offences in the 1983 amendment. It was intended to emphasize the violent facet of the crime as opposed to the ‘moral’ or sexual nature of the offence (Statistics Canada, 2008). With this legislation, three new categories (levels) of sexual assault were established. Basic sexual assault – minimal physical injury to the victim – is level 1 which is punishable by up to 10 years in prison; sexual assault with a weapon, threats to use a weapon or causing bodily harm, is level 2 which is punishable…

Nicholas Dixon in his writing, “Alcohol and Rape,” claims that there are established methods to determine what can define rape and impaired sex. However, there might be specific actions and motives that can complicate the two definitions, which results in unfair conclusions for the people involved in the sexual act. I find this claim likely because there might be certain circumstances in which rape and impaired sex cannot be determined. The complications involved in trying to determine impaired sex and rape are that both the terms depend on the act that was committed.…

    Consent In Rape Law

Consent is such an important issue in rape law because the two people involved in sextual intercource or planning to do it should both agree to it. If one person agree while the other doesn't that the one who does not should not be forced into it. It may be pleasure to one but it may be pain to the other. Then if there is no consent or agreement between those who are going to participate in sexual intercourse then the one who did not agree with it will be forcefully violated and would be participating in an act that was against their will. Consent can be demonstrated in a court of law by the individuals who participated in the activity stating that they agreed to it, that they signed some type of form or that they made sure that the person…

Introduction Perceptions about the severity of rape encompass considerations about the liability of the victim and perpetrator, assessments of motives, and numerous psychological consequences (Ben-David & Schneider, 2005). In a rape-supportive culture, minimizations of harshness of rape can be asserted by refusal to label the situation as rape or by characterizing the situation as not being psychologically damaging which is a violation of the rights of the victim (Glass, 2002). Traditional sex scripts of men and women create a rape-supportive culture in the United States (Check & Malamuth, 1983). Rape is a coherent extension of our cultures sex role socialization process that legitimizes coercive sexuality.…
