Started in the late 1800s, in New York bakers had been paid by the day and not by the hour. New York law limited the number of hours bakery employees were allowed to work at a fixed daily rate. Joseph Lochner had permitted an employee to work more than the lawful number of hours in one week causing him to get convicted and fined for this crime.
Constitutional Issue
If employees are to be paid at a day rate versus an hourly rate, working hours more than lawful would be unjust for said employee to make the same amount of income.
