You have asked me to write a paper based on the issue of rape kits in America being untested. Some of the questions to be addressed are, could the United States police departments be held liable for the amount of unprosecuted rapists and backlogged rape kits based on a theory of criminal negligence and or a theory of disruption of justice? Police offices across the country should be held liable for the mental stability and self-destructive states of the victims they have failed based on the same theories stated above; although improbable, it is completely legal to prosecute all officers involved.

Depending on the audience, rape is either seen as a crime or a civil rights violation, (Swan, pg. 963). Those who will view this as a civil rights issue, will argue for the universities to handle the consequences of rapists; however, seeing as civil rights are listed in the Constitution under Amendment IV “The right of the people to be secure in their persons…” it becomes difficult to argue that a violation of these rights is not in and of itself a crime and should be handled in the American courts, (Madison, amendment …show more content…
There is a complete lack of justice in this case when not only the perpetrator roams free to repeat this offense but the people who have been put in place to prevent that from happening, simply do not care. There is an excess of apathy in the United States Police Departments and that is simply unacceptable; further than that the amount of lethargy in the United States Justice System is what has fed the apathy of our police officers for so long. If no one will step ahead and argue these officials should be punished for a clear obstruction of justice, there needs to be serious reform in every area of our justice system.
Brief Prediction
Nothing is going to change. Although we were recently heading in the right direction for sexual assault reform, we took several steps back. Last month we elected one party into the Senate, House, Supreme Court, and Presidency. Many progressive changes made in our country will be tried and some may even be repealed with this much control by one group. Sexual Assault Reform Acts will most likely be the first under attack. Soon we will all be looking up to a man who would like us to all “grab ‘em by the pussy” and who has paid his way out of many rape cases in the past.
