"Bathroom Bias: Making the Case for Trans Rights Under Disability law” by Daniella Schmidt said how the “civil rights movements face more severe, pressing problems than bathroom access is misguided in multiple ways” (Schmidt 161). In contrast, someone who has no choice in the matter on who they are or the physical disability they possess has no impact on whether or not they decide to go into the opposite sex restroom. During the Civil Rights era, people that wasn’t physically born of Caucasian decent were denied in certain areas that was no near as an equal to facilities that have a much better quality. To add to it, the “courts see bathroom access as a "sex" issue and not a "gender" issue” meaning you are determined a male or female based on the physical genital from the time you are born. The idea of the federal government getting involved with is problem due to the fact that the states has more of an idea about the funding of the schools. Finally, a problem that can occur is that some schools wouldn’t be able to afford to lose their funding, causing a negative impact toward these institutions. Finally, when it comes to certain groups there has to be a line that determines what considers you a male or female, when reality someone being born from a different ethnicity or being gay determines whom they naturally
