In order to post bond, we require that the defendant's family show proof of identity and proof of income to get the ball rolling. Generally, all is required is a few pay stubs and a driver's license. A piece of mail with identifying name and address is also…
Bail in America is massively unjust today. In February of 2013, CBS News released an article where Jonathan Lippman—a judge from New York—said that the bail system is unfair to the poor. The way bail works is that when someone is arrested they have a bail hearing where a judge will determine the amount of money they would have to pay to remain out of jail before the court date. If bail cannot be posted, then that person would remain behind bars until the court date. In many cases the court date was weeks away.…
The Great Lockup The Great Lockup highlights the discrepancies in the criminal justice system that is subject to study in the modern American justice system. It was evident that there was racial discrimination in the investigative process and the eventual incarceration of the people arrested. The statistics indicate that 2 percent of the whites were locked in prison while over 9 percent of Black Americans were locked up. The disparity in the racial composition of the people incarcerated based on race shows that the policy of discrimination in the police force existed and some reform needed to be carried out for correct mechanisms to be initiated for a better future to be realized.…
During the initial appearance, bail is set. The defendant either pays the amount of the bail, which can be done in a few different ways, and is then released; or is kept in a local jail or lockup until their trial. The purpose of bail is to ensure the defendant returns for their future court dates.…
They are monitored by a tracking ankle bracelet that is able to tell exactly where the inmate is going, how fast they are going in their car, and latitude and longitudes of where they are at. This area of the jail is way more relaxed and easy…
Bail has been used for many years in the Criminal Justice system to reassure that an offender will return to his or her trial while awaiting at home. If they do return to their trial on the set date and it is completed, then the person receives their bail money back. But if they do not return to trial, their bail money is automatically forfeited and the offender risks being charged with not only their original crime but they might also be charged with failure to appear in court. The court mainly does this for rehabilitation but because of the way bail is chosen, it is easy to say that it could potentially affect an offender more than planned. They also use deterrence to keep a dangerous criminal incarcerated during their trial by purposely…
In the excerpt given from the “Debtor’s Prisons”, the author, Samuel Johnson is very unhappy with how prisons are being used to convict people unable to pay their debts. Samuel Johnson does not believe so many people should be thrown in jail so lackluster. He states that the men in the prison are “groaning in unnecessary misery” and are “pitied for a moment… and then forgotten.” Not only does he believe these people shouldn’t be imprisoned, he also believes that there is not enough enough awareness of what is happening to these men. Samuel Johnson says “more than twenty thousand are at this time prisoners for debt” and he later says that many of these men are “groaning in unnecessary misery” proclaiming that ther are innocent and should not be imprisoned.…
The amount of her bail the judge set for her was not an excessive amount, considering she had two felony charges against her. The amount of bond is set on several different factors, for example, whether the defendant has ties to the community, the likelihood of the defendant showing up for the next court appearance, and the prior criminal history (Bohm & Haley, 2014). Danielle does not have ties to the community. She has no family, no job, and no home that would keep her from fleeing these charges.…
A change such as this will have a domino effect and show other staff members that positive changes can occur and that the voices of the employees is valuable and is being heard. Parole is a major portion of every part of a prison facility and on a daily basis I personally speak to numerous counselors to answer time calculation questions, parole questions, probation questions and often why a person is back in prison questions. The parole department is vital to the timely release of offenders from the facility as well as the continued incarceration of those who violate the rules of parole. While all departments are interconnected, all departments rely on the parole process in some way. Whether it is because the parole board has mandated an offender…
but first did you know that if you are put in juvie there is a change that you could be put in prison because they can charge you with some things that are listed as an adult. The first thing i am going to tell you is that it is not safe to be put in prison because the place is so dirty and they don't have the things to make feel better if you are sick. Also some of the things you do when you are a teenager you can also be charged as a adult and you could go straight to prison.…
Balancing the tension between community interest and individual rights and freedoms are a significant component of the criminal trial process and is relatively successful in that retrospect. In order to be effective and efficient the criminal trial process should reflect the moral and ethical standards of society, ensure the community is sufficiently protected and respects the rights of the individual. However, despite efforts to achieve justice for all members of society, the criminal trial process does fail to provide adequate success in some areas of the law such as the jury system, Legal Aid and the provocation defence. All these areas to an extent highlight the lack of success the criminal trial process serves in balancing community interests…
Many people see civil asset forfeiture as a defective tactic used by the government. Civil asset forfeiture refers to a legal procedure by which the government is able to seize and ultimately forfeit the property of people suspected of wrong doing. The reason why people see this tactic as execrable is the fact that the government can seize property from people who were never convicted of or charged with a crime. Civil asset forfeiture is constantly seen as a way the government can victimize innocent people to make a profit on seized properties. Although this is a rather harsh tactic it is an absolutely credible tool used by the government and law enforcement agencies.…
Quite a few of these kids don't even know they have a parent in prison. They are told that the parent is on vacation or gone to a friend's. This causes even more issues with abandonment, because a child might be under the impression that their parent is choosing to be away from them. Small children whose parent or parents are incarcerated have multiple development issues and have lacking social skills. Often they don't know how to express how they feel and are isolated from adults and those peers.…
For example, juveniles offenders are not given the right to bail, and public…
Liberals see crime not as a product of individual moral failure but as the result of social influences (Currie, 1985). The root causes for crime is unemployment, racial discrimination, and government policies that work to the disadvantage of the poor. Liberals believe that the way to reduce crime is to change the social environment. The due process model reflects that police powers should be limited to prevent official oppression of the individual.…
