Apparent authority can be the source of confusion for patients when faced with negligent hospital care. When providing quality care, independently contracted physicians can prove to be beneficial for the hospital (Showalter, 2015). However, when mistakes are made, determining the liable party can be confusing for all involved. Patients, especially those receiving ambulatory care, cannot receive consent and information on who is providing the care and assumes responsibility on the hospital when it could be an independent physician. Risk management from hospital administration and a defined physician hospital relationship can help the health administrators reach conclusions that can help all parties improve the patients’ experience.

Typically risk management includes safety practices when providing healthcare in terms of biological, physical, and chemical safety (Balthazar, Andrade, Ferreira de Souza, Machado Cavagna, & Cavalcanti Valente, 2017). In terms of risk management, when it comes to apparent authority, involves the safety of the patient with a clear understanding of responsibility during a moment of liability. Accidents happen, and all care providers are human and bound to make an eventual mistake, risk management is knowing who is responsible and what can be done to prevent the same mistake from happening again. One resource, implemented by a hospital’s risk management team, is the use of consent forms. Consent forms are used to help educate the patient on the potential risks involved in their treatment, and the understanding of their options of choosing care and their care team (Showalter, 2015). Physicians typically have one of two options when working with a hospital, they can either work as a physician enterprise or as a co-management within the hospital. Under an enterprise, the physician is directly employed under the hospital although the overall practice is a separate legal corporation, independent from the hospital (Payton, 2012). Under a co-management, the hospital agrees to allow the physician to manage their own department within the hospital. This requires a larger commitment from the physician to manage their own administration, quality, and efficiency of their department. While the hospital provides support and medical resources available for the physicians (Payton, 2012).
