To begin with, the defendant has to request for a counsel at their arraignment. The defendant will also have to prove that he cannot financially afford a private attorney (Cohen, 2013). While the individuals' arraignment occurs the first question asked by the judge will be whether or not your represented by an attorney if the answers no they will also ask if you want to be appointed by one (Find law). Discuss the dual court system in the United States, and the structure of the federal court system, and your home state court system. The structure of the American court system has been viewed as complex and confusing as federal and state courts differ in jurisdiction, and types of cases that can be handled at the many different levels. The Supreme Court is the ultimate decision maker in cases that has been appealed regarding decisions made at the lower level of federal and state Supreme Courts. The dual court system operates within the boundaries of the state and federal court systems.…
1. The Supreme Court decisions in a case affect significantly the entire country’s legal system. Therefore, models of judicial decision making were created to explain the Supreme Court’s behavior and how they influence policies. While the legal, attitudinal and the strategic model are not the only theories of judicial decision making, those constitute the most prevalent hypotheses to explain judicial decisions.…
The Most Dangerous Game: What is the mental state of General Zaroff? General Zaroff is the main antagonist of the story The Most Dangerous Game. He's got it all but he still wants more.…
Many stories can have characters that are similar in multiple ways. A way two characters can be similar is by the way they change. The character Alice in the story “Alice” changes fairly identical to how Sanger Rainsford changes in “The Most Dangerous Game”. Both experience a dynamic approvable alteration from the beginning to the end of the story.…
The author Richard Connell uses his character’s attitude and the setting to create a sense of uncertainty in “The Most Dangerous Game.” For example, the large island Whitney and Rainsford see in the beginning of the story devises suspense. When Whitney says, “Off there to the right--somewhere--is a large island. It’s rather a mystery--” the reader knows the island will be important later in the story, but they don’t know the significance of the island or what is so mysterious about it. Additionally, General Zaroff’s pompous attitude creates uncertainty about what will happen next in the story.…
Throughout my reading I have decided to characterize a very warm-hearted human being who is known as Valentine Wiggin. To start, Valentine is a very intellegent person with the mind of a geniouse. When Peter and herself begain playing the roles of two made up characters- Demosthenes and Locke, she begain very well known in the nets. Playing as Demosthenes, Valentine would help spread ideas that could help change the world and find new solutions to world problems. After some time valentines ideas were being regarded throughout the major debates in the nets.…
Throughout history, there has been countless ways in which a judge has conducted themselves within a courtroom. Throughout this interval of recreation, there has been only a handful that have ultimately transformed the world we live in today. One of those is known as the Warren Court Era of 1953-1969. Within the courtroom, the Warren Court era has represented a time of trial, struggle, and change, crossing the lines that were once put in front of us to follow. This was a time when judicial philosophy re-defined the way in which we viewed the judicial system as well as a copious outbreak of judicial activism.…
Can an argument be made that alternative dispute resolution diminishes our constitutional rights to a fair trial? Compare and contrast the fairness between a civil trial court decision and a decision reached by a single mediator in a binding mediation. The fairness of a civil trial decision and a mediation decision has many differences, such as who makes the decision and whether or not there is a right of appeal. The fairness of a civil trial decision includes a judge, jury, a winner and a loser.…
They represent the defendant. However, the defense attorney plays a very important role in the criminal justice system, with that said, they are also faced with many ethical decisions within their duties. For example, defense attorney’s are often faced with knowing that their client is guilty, however, their job is to defend the justice system, the system of due process, and to ensure that due process is provided to their client. Furthermore, defense attorney’s are often approached by defendants, to compromise their integrity, thereby, undermining the criminal justice system, therefore, jeopardizing their ethics, and the oath to defend the “Bill of…
The prosecutors are considered to be the most influential actors within the courthouse, as they decide which case to prosecute, the cases to plea-bargain, and the case to try. The prosecutor may also influence the factors of setting bail and creating the sentence. In the United States Constitution, one’s Sixth Amendment right to counsel is granted as many defendants cannot afford to hire a lawyer, they are provided a public defender also known as the defense attorney. The defense attorneys encourage their clients to think about how the jury will assess them as guilty beyond reasonable doubt, therefore most will plead guilt. The judge plays a major authority role in the criminal justice system whether it is in state courts, or larger courts.…
Dworkin on Judicial Discretion in “Hard Cases” Lu Zhao Boyu (Bozy) | A0127866R In the standard courtroom, one could reasonably expect the judge to be the one responsible for the holding of a case. However, does and should the judge exercise his own discretion when deciding cases? Prominent legal theorist H. L. A. Hart claims that judges do exercise discretion, especially in “hard cases”, where there is no pre-existing or unambiguous rule. To this matter, Hart’s brilliant student Ronald Dworkin offers an alternative theory, which argues that judges do not have discretion and should follow principles instead of rules, even in “hard cases”.…
