In this case, the police would have to complete their investigation first because the elderly man turned himself in there is still protocol to follow. The detectives have to interview him and check out the crime scene location to see if the elderly man was telling the truth. The goal of the prosecutor is to seek justice in this case, and that does not always mean a conviction.

There are several decisions that the prosecutor has to consider before he decides to prosecute. The prosecutor will look at how strong the case and the evidence in the case.
