After reading the scenario it is my opinion that the defense attorney did not comply with his duties and responsibilities as an attorney. I also feel that his actions were unethical because a defense attorney’s responsibility is to provide a vigorous and competent defense for their client. Therefore, in this case he fails to do his duty as well as failed to represent his client appropriately because he gave him and his parents the wrong information. It was his job to prevent an innocent person from going to prison. They are also supposed to safeguard their clients constitutional rights as well as making sure that due process of the law is followed correctly in order to prevent an innocent person from going to prison. Unlike, a lot of crimes that happens this were a high profile case in which the prosecutor in my opinion was trying to make sure that he got a guilty verdict because a lot of people were killed and hurt. Therefore, the outcry of justice from the public in my opinion clouded his judgement in ensuring that everything was correct. Although, I do feel that the prosecutor could have not waived the right of the case to be heard in juvenile court because of the evidence he had pertaining to the case about a copy of the videotape interview were halfway through the interview the sound malfunctioned and four hours of the interview was silent. Therefore, I feel that there was a lot of information from the video that was left up to the interpretation of the judge because there was no jury. Yet, in the state that he lived in a juvenile charged with a crime could have a jury trial but unfortunately his attorney did not file a demand for a jury trial which was a mistake on his …show more content…
