There are some criminals who commit murders during self-defense or during time of passion. These criminals don’t deserve the death penalty. On the other hand, there are some criminals who don’t learn from the first lesson or others who just murder for fun; clearly they deserve the death penalty. What about criminals who commit murders and plead insanity? In my opinion, the criminals who plead insanity to get away with murders must have the death penalty because insanity implies an inability to react to the usual kind of incentives in the standard ways. If people, who have mental problems, are totally unresponsive to motivations, then their profits serve out no social need. I am not saying that all rationally disabled persons should be liable to death penalty since they are no great to the society. However, some people represent a great fatal danger to the communities and societies in such a remorseless way as seen in many cases. For example, Andrea Yates, who drowned her five children in the bathtub, plead insanity in a 2006 retrial and she is currently in a mental hospital. Where do we mark the line between rationally incapable and criminally crazy? At the point, when are they going to figure out how to continue the obligation regarding their activities and actions?
