This paper will discuss the cases of: Weeks v United States, Mapp v Ohio, Gideon v Wainwright and Scott v Harris. This paper will discuss which of these cases was the most important and it has impacted the criminal justice system. Each of these four Cases answered questions that influenced the criminal justice system to a whole new level.
Mapp v Ohio:
Police illegally entered the home of Dollree Mapp without a warrant. Officers were initially searching her home for a fugitive, but instead they found that she had possessed obscene (pornographic) materials. Consequently she was convicted, and then she appealed conviction on the basis of freedom of expression. When Gideon appeared in court without a lawyer, he requested for one to be appointed to him. Under Florida state law, the courts did not have to grant him with a lawyer so they didn’t. Gideon then took the case to the Supreme Court because he thought that it violated his sixth amendment, which is a right to council. The Supreme Court then determined that the framers of the constitution believed that the accused should have the means to put up a proper defense (fair trial) as stated in the Sixth Amendment, which is the right to counsel. This means that State and Federal courts are required to appoint attorneys for defendants that cannot afford to retain counsel on their own.
Scott v Harris:
Deputy Timothy Scott attempted to pull over Victor Harris for speeding. Harris then fled in his vehicle, creating a high speed car chase. This resulted in Deputy Scott attempting to end the chase by ramming Harris 's vehicle with his police cruiser, rendering Harris a quadriplegic. As a result, the Court determined that a police officer to use deadly force to prevent harm to innocent bystanders if needed. This ruling also means that they can do this even if they are putting the criminal in serious risk of injury or death.
