The Consequences Of Free Speech

Improved Essays
Free speech is a great part of being an American but it can have consequences. Which is why I agree with the Supreme Court's decision allowing the Westboro baptist church to protest at a military funeral because they followed the rules and law, it is their right to the first amendment, and they shared their beliefs and point of view on a public topic.

As harsh as it is protesting at a Military funeral, the Westboro baptist church had every right to speak their mind. They followed the rules and laws by staying 1,000 feet from the funeral like the police had told them. Margie Phelps, the lawyer of the westboro baptist church said, “We read the law. We followed the law. The only way for a different ruling is to shred the first Amendment.” This is very true they did not break any laws and they have the first amendment protecting them. And Albert Snyder didn't see the protests until he surfed the internet and saw Westboro’s letter to him.

The Westboro baptist church could protest at a Military funeral because it is their right to the first amendment. The first amendment means freedom of speech including hate speech. This case has been like many past court decisions, the first amendment exists to protect robust debate on public issues and free expression, no matter how distasteful. The court protects hurtful speech on public Issues to ensure that we

During the funeral, the Phelps family were not personally attacking Albert Snyder or his family but expressing their deeply held views on public topics. As controversial and distasteful Westboro's beliefs are, this is their religion and they are passionate about their beliefs, you can not tell people what faith to believe or what morals to have. They also have freedom of religion protecting them. If Albert Snyder won it would be like punishing Westboro for seeking to communicate their view on matters of public

The agency has refused to deliver services to Gay/Lesbian/Bisexual/Transgender people, and now there’s a pending legal class action suit filed against the agency, its staff and its Board of Directors. The Supreme Court's ruling in Snyder v. Phelps was fair because they are protected by freedom of speech, it was a peaceful protest, and because they weren't right next to the funeral. One reason why this ruling was fair was because the protesters were protected by freedom of speech. In the 1st Amendment of the United States Constitution, it states that people have the right to express their thoughts freely. No matter what pain or grief they were causing towards Snyder, they were still under the protection of the freedom of speech. Another reason why this ruling was fair was because it was a peaceful protest.…

The first amendment allows American people freedom of speech, freedom of the press, and most relevant to this case - the right to protest. Practicing your right to protest is a core democratic value, as it allows the people to have their own voice in our government. At the political rally in Texas, Johnson was simply practicing his right to protest, although a few individuals were sickened by this display, no person was in any danger, nor verbally assaulted. In the Chaplinsky case, there were cases of verbal assault, including insulting phrases such as “You are a God damned racketeer.” and “A damned Fascist and the whole government of Rochester are Fascists or agents of Fascists.”…

I agree with Caleb Yong article on how free speech is important because he explained how lead each person to form the own ideas and opinion and individualize themselves, and although it can lead to hate speeches there is also speeches that benefit for the better. It’s important for people to speak your opinion and ideas without having to have restriction on how important the matter is to you. Every speech has its negative and positive points but it usually the benefits out weigh the negative factor of the speech. I do think that is very important to keep in mind that every action has its…

The First Amendment was created to allow all people in America to openly express their opinions, regardless of popularity. I believe that white supremacists should no exception. However, the issue arises when the speech sprouts fear and racially motivated hate crimes. Therefore I believe that it is important for all speech; including white supremacists, to be protected by the First Amendment, unless the speech escalates to a point where human lives are at stake. White supremacists should have the right to voice their opinions without “the fear of being labeled and actual Nazi” (Fox News), and without compromising their safety.…

Phelps the supreme court discussed whether or not the Westboro Baptist Church had the right to protest at funerals or not. They decided in an 8-1 vote, “that the First Amendment shields those who stage a protest at the funeral of a military service member from liability,” (Snyder). It’s right that these church members should be able to exercise their right in protesting whatever they please. However, these protests can be taken as harassment, violent, and public embarrassment. Soldiers died for their right to use their first amendment right and they don’t have the decency to let their family members mourn in peace.…

When the court ruled that Phillips had to bake a cake for Charlie and David, he did have his First Amendment rights violated. In the future, the court should consider a different ruling, such as a fine and allow people to run their business in a way that doesn’t violate the Colorado Anti-Discrimination Act, rather than forcing him to provide the service. My decision would support the reasoning that people can have their own beliefs under the First Amendment, as long as they do not violate the rights of another. My decision would not force Jack Phillips to make wedding cakes for same-sex couples unless he is making them for heterosexual couples; he has the decision to make wedding cakes for everyone, or for no one. This ruling supports that the Civil Rights Act of 1964 and the Colorado Anti-Discrimination Act are…
