It has been over twenty years since individuals with disabilities earned the entitlement to be acknowledged by Canada’s Constitution and from that time people with disabilities have entered the court demanding that the Canadian judicial system focus on their rights and eliminate discrimination from the laws and institutions of Canada ("People with Disabilities and the Charter: Disability Rights at the Supreme Court of Canada Under the Charter of Rights and Freedoms"). This research paper will focus on section 15 (1) of the Charter Rights and Freedoms, particularly; it will aim on the guarantees of a person with disabilities, their right to equal protection and benefit, and to not be discriminated by the government and their delegates. I will examine how the Charter Rights and Freedoms provides an equal rights to protection and equal benefit, without discriminating individuals with disabilities and discuss cases that the Supreme Court of Canada has chosen to hear which are related to disability.

Even though the Charter of Rights and Freedom states that all Canadians are guaranteed “equality, [recognizing] the particular discrimination experienced by certain groups because of their race, sex, religion, age etc… however, missing from this list was the discrimination experienced because of a disability” ("People with Disabilities and the Charter: Disability Rights at the Supreme Court of Canada Under the Charter of Rights and Freedoms").
